FDA Compliance Purchase Agreement 

Physical therapists and other allied health professionals who are not licensed by law to practice acupuncture cannot legally purchase acupuncture needles.The Food and Drug Administration (FDA) classified acupuncture needles as Class II medical devices subject to strict regulations under the federal Food, Drug, and Cosmetic Act (FDCA) and FDA’s regulations. Individuals purchasing or receiving acupuncture needles who are not licensed by law to practice acupuncture are directly violating both civil and criminal provisions of the FDCA intended to protect public safety. 21 U.S.C. § 331(a)–(c), (g). These include the FDA’s requirements that acupuncture needles can only be sold to “qualified practitioners of acupuncture.” 61 Fed. Reg. 64616 (December 6, 1996). Also, any individual who is not licensed by law to practice acupuncture is directly violating the FDCA and FDA’s civil and criminal prohibitions when they purchase or receive acupuncture needles for use in “dry needling.” The use and purchase of acupuncture needles for “dry needling” violates federal criminal and civil laws.


Acupuncture Needles
Federal law restricts the sale of acupuncture needles to or on the order of qualified practitioners of acupuncture as determined by the states. In compliance with the FDA, and State regulations that restrict the use of acupuncture needles to qualified practitioners, Our company will sell acupuncture needles and devices to licensed professionals only. All acupuncture devices are sold to qualified practitioners only. First-time orders for acupuncture needles, TENS and acupuncture stimulators, and etc:  Please note that your acupuncture license must be verified before your order is completed. No medical claims are intended or implied for any products sold. The purchaser accepts full responsibility for the safe and proper use of these devices and agrees to indemnify and hold harmless the supplier and manufacturer from any consumer claims against these products or their ultimate use. FDA Compliance Purchase Agreement 

TENS, EMS & Micro-Current Devices
Federal Law restricts the sale of TENS, EMS and Micro-Current devices to or on the order of a licensed physician. Due to the restriction and limitation, we are not making any medical claims on the acupuncture needles and relevant acupuncture supplies on our web site. The purchaser accepts full responsibility for the use and distribution of those devices; and agrees to indemnify any consumer claims against Acudepot for the use of those devices. 

Herbal and Homeopathic Products
Herbal products are food supplements. All statements made describing all products that are sold and or distributed by Acudepot have not been evaluated by the Food and Drug Administration. All herbal and homeopathic products sold by Acudepot are not meant to treat, cure or prevent disease. Under no circumstances does Acudepot imply that any and all products and formulas are meant to diagnose, treat, cure or prevent any disease. The Customer has not relied upon Acudepot’s skill, judgment or representation in selecting or acquiring herbal, homeopathic and all other products, and that the Customer has relied upon their own skill, judgment and expertise. All requests for diagnosis or product recommendations should be directed to a licensed acupuncturist or TCM herbalist or licensed physician.

Do not use magnets or Electro devices if you are fitted with Pace-Maker, Defibrillator, or during pregnancy. The medical evaluation of your physician is advised at all times. Any self-help application is the responsibility of the user. Magnets can erase video, music, and computer data. Acudepot does not make or imply any medical claims on products described in this online catalog or for any item that is sells. 

Jurisdiction and Venue

You agree that any legal action brought against Acudepot shall be governed by the laws of the State of California without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders placed on the Acudepot web site shall be at an appropriate federal or state court located in LA County, California.


Typographical Errors

In the event a products is listed at an incorrect price due to typographical error or error in pricing. Acudepot shall have the right to refuse or cancel any order(s) laced for product listed at the incorrect price. Acudepot shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Acudepot will issue a credit to your credit card account in the amount of the incorrect price.
 

 Shipping Policy

Shipping Rates
For a domestic shipping estimate, we calculate the shipping and handling charges based on the weight of the shipment. For international orders, please follow the instructions below. 

Continental US
Your order will be shipped out of the warehouse within 48 hours of receipt Mon-Fri. 
Our standard mode of delivery is Fedex ground (unless otherwise selected). 
All packages will ship "signature required" - someone must be present at the time of delivery.

International
Your orders can be sent nearly anywhere in the world. To receive a custom international shipping quote, please submit your information to. Our international customer service agent will then email you a quote within 24 business hours.

All taxes, duties and brokerage fees are the responsibility of the customer and will be added to shipping at the time of order entry. 

Oversized / Heavy Items

The lowest charge applies to oversized and overweight items such as massage tables, chairs, hydro-collators, massage stones.

Manufacturer Direct Shipping

Products with an item status of "Drop Ship" ship directly from the manufacturer. We can confirm the date the item was shipped and, upon request, provide you with tracking information. 

Important Disclaimer
All products and risk of loss are FOB seller’s warehouse. All shipping charges are the responsibility of the purchaser.

When you place an order with AcuDepot, we ask your name, your billing address, the address for shipment of the order, your credit card number and expiration date and your e-mail address. We consider this information private. The information is kept on a secure server to protect it from outside parties. We use the information only for the limited purposes of processing your orders, for statistical purposes to improve our site and services to you.

 Return / Exchange Policy

Acudepot guarantees satisfaction with every product we sell. If an item does not meet your expectation, please follow these procedures within 30 days from the date of shipment to insure a prompt replacement, refund, or credit.

New and Un-opened Returns within 30 days: We are happy to accept products that are returned within 30days from the date of shipment in new condition and in their original packaging. Customer is responsible for return shipping cost. Items returned after 30 days will incur an additional 25% Restocking Fee. Items over 60 days may not be returned. 

Retrun Policy
Return, refund and exchanges must be made within 30 days of purchase: All returns must be accompanied by a copy of your invoice. We will refund your original purchase price less the actual shipping costs. If your order qualified for free shipping, your refund will be for the amount of the item(s) less the cost for us to ship the order to you. Pricing for returned items will be based on the actual price you paid according to our records. All returned merchandise must be in it's original packaging, in unused re-saleable condition. Computer software once opened is not returnable. Needle boxes once opened are not returnable. Any herbal products once opened are not returnable. We reserve the right to impose up to a 25% re-stocking charge. You must contact us prior to return, to obtain a return authorization number which must be written on the outside of the box and on your invoice enclosed with the returned items. When you obtain the authorization number, you will be given the proper address to send back the returned item's. We will not accept any package that does not have a return authorization number written on the outside of the package!

Retrun Policy - International Orders
There are no returns allowed for International orders. All sales are final! You are advised to investigate your country's rules and regulations regarding the products you are interested in purchasing before placing your order. AcuDepot will not be responsible for any difficulties encountered with the importation of our products.

Non-Returnable Items
For obvious reasons, we cannot accept returns on opened products like oils, lotions, personal care products, creams, books, videos, music, CDs, DVDs, brochures and software. Returns on washed linens, worn clothing, or used disposable garments will not be accepted. Special orders and custom built tables are non-returnable.

Defective/Damaged Products
Although we carry high quality products, we recognize that sometimes there will be that occasional defective or damaged unit that you were unlucky enough to receive. Within the first 30 days of the date you receive your order we will be happy to replace or repair the item at no additional cost to you. Please call Customer Service at 1-800-404-7376 and they will walk you through the returns process.

How to Return Non-Defective Products
All returns MUST have a Return Authorization Number (RA#) printed on the outside of the shipping box. If we don't see an RA#, the box will be returned to you at your expense. Please follow these steps to insure a prompt replacement, refund, or credit:

Step 1. Warranties

Our warranty for all durable products is 90 days or manufacturers warranty, whichever is longer. This warranty does not cover damage from mishandling, dropping or alterations. Please return damaged or defective items securely packaged.

Step 2. Contact our customer service

Call 1-800-404-7376 and ask for Customer Service. After speaking with a representative, you will be issued a Return Authorization Number (RA#). YOU MUST RECEIVE a Return Authorization Number before sending back a product. Include a note stating purchaser's name, address and order number and reason for return. Be sure to include RA#. Using a good carton, return package via insured US Mail, UPS or FEDEX.

Pricing and Availability

All products are subject to availability and prior sale. All prices appearing in our catalogs or website are subject to change without prior notice. Acudepot is not responsible for misprints in our catalogs or online. All orders are subject to acceptance by Acudepot. 


Payment Methods
We accept Visa, MasterCard ,American Express and personal checks, money orders.

We accept only postal money orders denominated in U.S. dollars or checks denominated in U.S. dollars and drawn on a U.S. bank. Checks must also have a valid nine-digit bank routing number (ABA code) MICR-encoded on the bottom of the check. 

Order Cancellation
If you need to cancel or amend your web order, please call as immediately as once your order is sent to our warehouse it is difficult to prevent shipment. If you decide to cancel your order after the deadline, we'll simply process your request as a return. 

Backorders
If a backorder causes your order to be sent in more than one shipment, we pick up the cost of regular shipping on all shipments following the original order (excluding international orders). All overweight item charges apply. 

Custom Orders
All custom orders are subject to the manufacturers terms and may cause a delay in shipping or additional, non-published fees. 

Quantity Discounts
Quantity price breaks may be available in addition to what's offered in our catalog and online. Please call us for more details. 

Clearance Items
Clearance items have limited quantities; sizes/colors may no longer be available. Clearance items are not returnable. 

Sales Tax
We charge sales tax for shipments to the states of California. If you live outside CA, you will not be charged sales tax. 

Gift Certificates
Gift Certificates are only available by calling 1-800-404-7376. You may redeem it over the phone or by mailing it with your order. Gift Certificates are available in any denomination.
